The protection of your personal data is important to NOVAL.

This privacy policy sets out how NOVAL collects, uses, stores and protects personal data that may be processed when using its websites and in the course of any resulting communications.

This policy applies to websites published by NOVAL, and in particular:

These various sites are hereinafter collectively referred to as the «Sites».

3. Data that may be collected

Depending on how you use the Websites or interact with NOVAL, we may process the following categories of data, amongst others.

Surname, first name, email address, telephone number and, where relevant, postal address.

Professional details

Company, role, country, sector, business contact details and any information relating to the company or project you represent.

Information provided in your enquiries

The content of a message sent to NOVAL, including requests for documentation, technical enquiries, sales enquiries, requests for quotations, and information relating to a project, product or application, as well as any attachments sent.

Data relating to the business relationship

Correspondence history, quote requests, project-related information, products requested, orders and details required to manage the business relationship.

Recruitment data

When you apply to NOVAL: your identity, contact details, CV, career history, education, skills, cover letter or motivation message, as well as any other information you choose to provide as part of your application.

Technical and navigation data

Depending on the settings used on the Websites: IP address, device type, browser, operating system, pages viewed, date and time of visits, source of the visit, browsing activity and technical information necessary for the security and operation of the Websites.

Data relating to cookies and trackers

Identifiers or information relating to your device may be processed when you accept certain cookies or other trackers, in particular for the purpose of audience measurement.

NOVAL would ask you not to submit, via the Websites, any sensitive data or information that is not necessary for the processing of your enquiry.

5. Contact forms and commercial enquiries

The information provided via the forms on the Websites is used to process your enquiry and enable the relevant NOVAL teams to respond to it.

Some fields may be compulsory where the relevant information is required to process your enquiry. The other fields are optional.

Information may be forwarded internally to the NOVAL department or to the most appropriate person, depending on the nature of your enquiry and the relevant sector: Home, Street, Yacht, Industrial or another NOVAL business area.

When an enquiry leads to a business relationship, the relevant information can then be incorporated into the sales management tools used by NOVAL.

6. Business development and communications

NOVAL operates primarily in the B2B sector.

NOVAL may use the business contact details of prospective customers, customers or partners to send them information about its products, services, innovations, events or activities where there is a relevant business interest and where permitted by regulations.

Each recipient may opt out of these communications at any time, in particular by using the unsubscribe link included in the relevant messages or by contacting NOVAL.

Where regulations require prior consent – in particular for certain communications sent to individuals – no communication of this nature is sent without the required consent.

7. Applications and recruitment

When you submit an application to NOVAL, the information you provide is used to assess your profile, contact you and manage the recruitment process.

The data required for an ongoing recruitment process is retained for as long as is necessary to process the application.

With your consent, where required, NOVAL may retain certain information in order to contact you regarding future career opportunities.

The data of an unsuccessful candidate retained for this purpose are, in principle, not kept for longer than two years from the last contact, unless an agreement provides for a different duration or a specific obligation applies.

8. Recipients of the data

To the extent necessary for the performance of their duties, the data may be made available to:

  • to authorised NOVAL staff; ;
  • to the relevant sales, marketing, communications, administration, IT, human resources or technical departments; ;
  • to the group companies to which NOVAL belongs, where their involvement is necessary for the request in question; ;
  • to IT service providers and service providers responsible for the hosting, maintenance, security or development of the Websites; ;
  • to suppliers of communication, sales management, email or audience measurement tools used by NOVAL; ;
  • to advisers, experts, insurers or the relevant authorities where required by law or to protect NOVAL’s interests.

These recipients only have access to the data to the extent necessary for the performance of their duties.

Where service providers act as subcontractors, NOVAL ensures that they provide appropriate safeguards regarding the protection of personal data.

NOVAL does not sell the personal data collected on its websites to third parties.

9. Google Analytics and audience measurement

The Websites may use Google Analytics to enable NOVAL to understand how its websites are used, identify the content viewed and improve their performance and user-friendliness.

Where the configuration in use involves the setting or reading of consent-based trackers, Google Analytics is only enabled once you have given your consent via the cookie management tool.

Refusing these cookies does not prevent you from accessing the Websites.

NOVAL may also upgrade its audience measurement tools and use solutions that enable it to compile statistics in circumstances that meet the criteria for exemption from the requirement to obtain consent, as set out in the regulations.

11. Retention periods

NOVAL retains personal data only for a period proportionate to the purpose for which it was collected.

In general:

Enquiries and leads
Data used for marketing purposes may be retained for up to three years from the date of collection or from the prospect’s last contact.

Customers
Data is retained for the duration of the business relationship and may subsequently be archived for as long as is necessary to comply with legal obligations or to defend NOVAL’s rights.

Accounting documents
Documents subject to a statutory retention obligation may be retained for ten years where required by accounting regulations.

Opposition to exploration
The information strictly necessary for the processing of an objection may be retained for at least three years in order to avoid having to contact the person concerned again.

Applications
Where an unsuccessful application is retained for future opportunities, the period for which it is retained is, in principle, limited to two years after the last contact, unless an agreement has been reached to allow for a different duration.

Technical and safety data
They are retained for as long as is necessary to ensure the security, diagnosis and proper functioning of the Websites, and are then deleted or anonymised.

Cookies and audience measurement data
The duration depends on the type of tracker and its purpose. It is specified in the cookie management tool. NOVAL ensures that these durations are limited to what is strictly necessary.

Where data is no longer required in the active database but must be retained to comply with a legal obligation or to enable the establishment, exercise or defence of legal rights, it may be archived with restricted access.

12. Data transfers outside the European Economic Area

Where possible, NOVAL gives preference to service providers and solutions that enable data to be processed within the European Economic Area.

However, certain international service providers, in particular some digital service providers or audience measurement providers, may process or make certain data accessible from countries outside the European Economic Area.

Where such transfers take place, NOVAL ensures that they are based on a mechanism provided for by the GDPR, in particular:

an adequacy decision by the European Commission, standard contractual clauses approved by the European Commission, or any other mechanism ensuring an adequate level of protection.

Additional safeguards may be put in place where necessary.

13. Data security

NOVAL implements technical and organisational measures designed to protect personal data against destruction, loss, alteration, unauthorised disclosure or access.

These measures may include, amongst other things, encrypting communications with the Websites via HTTPS, managing and restricting access rights, securing accounts and infrastructure, taking backups, carrying out security updates and monitoring systems.

As no IT system can guarantee absolute security, NOVAL adapts its security measures in line with the risks and technological developments.

Depending on the processing in question and its legal basis, you may have the following rights:

  • right to erasure; ;
  • the right to restriction of processing; ;
  • the right to object, in particular to direct marketing; ;
  • the right to data portability where the legal conditions are met; ;
  • the right to withdraw your consent at any time where processing is based on that consent.

You may also set out instructions regarding what is to happen to your personal data after your death, in accordance with the provisions of French law.

In order to prevent any disclosure of data to an unauthorised person, NOVAL may request information to verify the identity of the applicant where necessary.

A copy of an identity document is only requested where the circumstances warrant it.

NOVAL responds to requests within the time limits set out in the relevant regulations.

16. Complaint to the CNIL

If, after contacting NOVAL, you feel that your rights regarding your personal data have not been respected, you have the right to lodge a complaint with the National Commission for Information Technology and Civil Liberties (CNIL).

17. Automated decisions

The processing carried out by NOVAL via the Websites is not intended to result in a decision being taken in relation to you that produces legal effects or significantly affects you on the sole basis of fully automated processing.

18. Third-party websites

The Websites may contain links to third-party websites or services.

NOVAL is not responsible for any data processing carried out directly by these third parties. We encourage you to consult their own privacy policies before providing them with any personal data.

19. Changes to this policy

NOVAL may amend this privacy policy to reflect changes to its websites, tools, data processing activities or regulations.
